PRIVACY POLICY:
At Jack and Purdy Photography, we are committed to protecting the privacy of our customers, especially when it comes to the personal information of parents/guardians and students. This privacy policy outlines how we collect, use, and protect the information we receive in the course of providing our school photography services in accordance with the Australian Privacy Principles as outlined in the Australian Privacy Act.
Information Collection and Use. The school is responsible for obtaining consent from parents/guardians and providing us with the information that is necessary for us to provide photography services. If you do not wish for your child/ren to participate, you must let your school know prior to the scheduled photo day/s. This includes participation in group photos which are made available to multiple parents/guardians and other school community members. Information provided to us by the school may include, but may not be limited to:
Student Names
Student ID
Class/Group Names
Email address of parent/guardian
When you access the portal for viewing proofs and ordering images, we will ask you for additional information in order to process your order. This may include, but may not be limited to:
Parent / Guardian or username
Telephone number
Parent or user email address
Invoice address
Delivery address
Information collected may be used for the following purposes:
To send email communication between yourselves and Jack and Purdy Photography when you purchase your photographs from the site such as confirmation of orders and payment.
To allow us to send you emails and/or texts to advise you when your gallery is open and ready to use and when offers, such as, batch shipping are due to close*.
To send you details of offers or new products that may be of interest*.
We also process personal data on the basis of legal requirements. For example, we store invoice data (name, address) on the basis of existing legislation for Legal and Accounting records
* You have the option to opt out of receiving these communications when you create your account.
Photography Services: We photograph individuals, siblings, classes, and group activities as requested by the school. Images are made available to authorised users for secure online viewing and ordering. (see Orders and Payments).
Third‑Party Services: On occasion, we may engage trusted third‑party providers for specific services related to our photography services, such as image processing, managing session bookings, managing payment processing. This includes ‘Netlife’ who are contracted to Jack and Purdy Photography to enable secure encrypted and password access to your Photos. Any providers we use are required to comply with Australian privacy laws and industry‑standard security measures. Personal information is shared only when necessary to deliver our services and is done securely through encrypted means.
Orders & Payments: Images are made available to order through ‘Netlife’ a secure encrypted portal with password access to your photos that has been carefully chosen and verified to be compliant with GDPR and Australian Privacy Laws and that appropriate measures are in place to ensure the security and confidentiality of the information collected and implement safeguards against unauthorised access, alteration, disclosure, or destruction of personal information.
To access the platform, Parents/Guardians, as authorised by the school, will be emailed with instructions on creating a secure account within the system. The Terms of Use and Privacy Policy of the platform are readily available on the login page.
Once you have created a secure account on the platform, you can access, manage, and delete your account information. User support for the platform is also available to assist with any enquiries related to privacy or account management.
Note - you may only purchase photographs where you have a legitimate connection to the subject. We may request verification of this connection and may refuse service if it cannot be reasonably established. Where appropriate, we may provide relevant information to authorities.
Please note that group photos are not able to be deleted by the account holder as they are available to other users within your school community relevant to the subject pictured.
Only information necessary to process orders is collected. This may include but is not limited to, parent name, delivery address, and phone numbers. We do not store credit card details, as all payment transactions are processed through secure third-party payment gateways.
Image Use & Marketing: We will only use photographs or images for marketing or promotional purposes where explicit written consent has been provided by a parent or guardian. Declining consent for image use does not affect image availability or purchases.
Disclosure of Information: We do not disclose any personal information to third parties, except for those as outlined above or those that are necessary for us to provide school photography services.
We may disclose personal information if required to do so by law or with the explicit consent of the individuals involved.
Data Retention: Personal information and images are retained only as long as reasonably necessary for business, contractual, and legal purposes. Accounting records are retained for seven (7) years as required by law. We are not required to retain photographs for any specific period and may archive or delete images at our discretion.
Cookies: We use cookies and similar technologies to support website functionality and analytics. You can manage cookie settings through your browser.
Your Rights: We are committed to upholding your rights regarding your personal information in accordance with Australian privacy laws.
Parents and Guardians using the system can go to their account and opt out of the communication for all/selected connected subjects. If new subjects are added to their account later, communication for these are automatically allowed until it is disabled by the user.
Jack and Purdy Photography at your request, can confirm what information we hold about you and how it is processed.
If you have given us consent to process your personal data for certain purposes (e.g. publication or use of images), the legality of such processing is based on your consent. You may revoke your consent at any time with effect for the future. Please note that the revocation only takes effect in the future. Processing carried out before the revocation remains unaffected.
We reserve the right to modify or update this Policy at any time, without prior notice, to reflect changes in laws, regulations, or business practices. It is your responsibility to review this Policy periodically to stay informed of any updates.
